Resumen
El objetivo de este trabajo es examinar la idoneidad del Derecho Internacional Humanitario (DIH) como marco jurídico de las ocupaciones beligerantes prolongadas. Mediante el método del caso de estudio, centrado en la ocupación de Palestina, trataremos de arrojar luz sobre la aplicabilidad del DIH a las ocupaciones beligerantes que se dilatan considerablemente en el tiempo y, en su caso, si el factor temporal exige ajustes en la aplicación de este cuerpo normativo. De nuestro estudio se desprende que, si bien el derecho de la ocupación beligerante puede autorizar al ocupante a otorgar un tratamiento jurídico diferenciado para los nacionales del Estado ocupante y los del territorio ocupado, ello no significa que este pueda establecer un sistema de discriminación y opresión a largo plazo, bajo la cobertura de que es solo provisional.
